This website, available at berrypuff.com, is operated by BerryPuff.

The terms “BerryPuff”, “we”, “us” and “our” used in this document refer to BerryPuff.

Through this website, we provide users with information, content, tools and the opportunity to purchase our products, subject to these Terms and Conditions, the referenced policies and applicable law.

By visiting the website or making a purchase, you accept these Terms and Conditions of Service. Please read them carefully before using the website or completing an order.

If you do not accept these Terms, do not use the website or its services.

Our store is hosted on the Shopify platform, which provides the e-commerce infrastructure we need to present and sell our products.

SECTION 1 – REQUIREMENTS FOR USING THE WEBSITE

To make a purchase, you must be at least 18 years old or have the legal capacity required to enter into a contract.

If you use the website on behalf of another person or organisation, you confirm that you are authorised to act on their behalf.

You may not use the website, products or services for illegal, fraudulent or unauthorised purposes.

You may not transmit viruses, malicious code or anything capable of compromising the operation of the website.

SECTION 2 – SCOPE OF THE SERVICE

BerryPuff offers handcrafted pet beds and accessories with a modular structure and the option to replace or renew certain textile components.

The main features, dimensions, colours, materials, prices and availability of products are shown on their respective pages.

Images and settings aim to represent the product as faithfully as possible. However, colours may appear differently depending on the screen used.

As these are handcrafted products made from selected fabrics, slight variations in shade, weave, stitching or finish may occur. Where these variations do not affect the use, quality or essential characteristics of the product, they do not constitute a defect.

SECTION 3 – PRODUCT AVAILABILITY

Products may be available in limited quantities, including due to handcrafted production or fabric availability.

The presence of a product on the website does not guarantee that it will remain available until the order is completed.

If a product or material becomes unavailable after purchase, we will contact the customer to propose:

  • an alternative variant;

  • a revised timeframe;

  • an amendment to the order;

  • cancellation with a refund of amounts already paid.

We reserve the right to change or discontinue the sale of a product, without affecting orders already confirmed.

SECTION 4 – PRICES

All prices displayed on the website are in euros and include applicable taxes, unless otherwise stated.

Any additional costs, including shipping where applicable, are displayed before the order is confirmed.

Prices may change at any time. Changes do not apply to orders already confirmed.

In the event of an obvious error in price, description or configuration, BerryPuff may contact the customer to correct the order or cancel it, refunding in full any amounts already paid.

SECTION 5 – ORDERS

To make a purchase, select the product and its variants, add it to your basket and complete checkout, providing complete and accurate information.

Before confirming the order, the customer is responsible for checking:

  • the selected product;

  • size;

  • colour;

  • quantity;

  • delivery address;

  • contact details;

  • payment method.

After completing the purchase, you will receive a summary email at the address provided during checkout.

BerryPuff may refuse or cancel an order in the following circumstances:

  • the product is unavailable;

  • an obvious error in price or description;

  • payment is not authorised;

  • incomplete or unverifiable information;

  • suspected fraud or unlawful use;

  • delivery cannot be made.

If BerryPuff cancels an order that has already been paid for, the amounts received will be refunded.

SECTION 6 – CHANGING OR CANCELLING AN ORDER

If you would like to change or cancel an order, contact us as soon as possible at info@berrypuff.com.

We will do our best to act before preparation or shipping begins, but cannot guarantee that a change or cancellation will still be possible.

If the order has already been handed to the courier, you must follow the procedure set out in the Returns and Refunds Policy.

For personalised products or products made on specific request, changes or cancellation may not be possible once production has begun.

SECTION 7 – PAYMENTS

Payments are handled through the available methods displayed at checkout.

Depending on availability, these may include payment cards, PayPal, Apple Pay, Klarna or other authorised services.

BerryPuff does not directly store full payment card details. Transactions are processed by Shopify and the selected payment providers under their respective terms and policies.

The customer is responsible for the accuracy of the information used for payment and confirms that they are authorised to use the chosen method.

An order may be suspended or cancelled if payment is not authorised or completed.

SECTION 8 – SHIPPING AND DELIVERY

For standard orders delivered in Italy, the estimated total timeframe is 5–7 business days from order confirmation.

This timeframe includes handcrafted preparation and subsequent transport by courier.

Times may vary during public holidays, promotions, periods of high demand, personalisation requests or circumstances outside BerryPuff’s direct control.

Standard shipping is free for orders delivered in Italy, unless different conditions are clearly stated before purchase.

The customer is responsible for entering an accurate and complete address.

SECTION 9 – RIGHT OF WITHDRAWAL

The consumer may notify us of their decision to withdraw from the purchase within 14 days of delivery of the product, without giving a reason, in the circumstances and in accordance with the procedures provided for by applicable law.

To request a return, you must contact BerryPuff at info@berrypuff.com.

Return costs for a change of mind are the customer’s responsibility, unless otherwise stated or where the product is faulty, damaged or incorrect.

The product must be returned with all its parts and without signs of use beyond what is necessary to establish its nature, characteristics and functioning.

SECTION 10 – PERSONALISED PRODUCTS

The right of withdrawal may be excluded for products made to measure or clearly personalised in response to a specific customer request.

Examples in this category include:

  • dimensions not listed in the catalogue;

  • structural modifications requested by the customer;

  • fabrics specially ordered or selected;

  • personalisation clearly agreed before production.

Simply choosing a size, colour or variant normally available in the BerryPuff catalogue does not, by itself, constitute personalisation that excludes the right of withdrawal.

Any specific conditions relating to a personalised product will be communicated before final confirmation of production.

SECTION 11 – STATUTORY GUARANTEE OF CONFORMITY

Products sold to consumers are covered by the statutory guarantee of conformity provided for by applicable law.

A product is considered to conform when it:

  • matches the description provided;

  • has the promised qualities and characteristics;

  • is suitable for its normally intended use;

  • is delivered with the components specified in the order.

The statutory guarantee does not cover damage caused by:

  • improper use;

  • washing or care that does not follow the instructions;

  • normal wear;

  • damage caused by the animal;

  • modifications made by the customer;

  • accidents or causes not attributable to BerryPuff.

If you believe the product is faulty or does not conform, contact us at info@berrypuff.com and include the order number, a description of the problem and, where possible, photographs.

We will assess the request and propose the remedy provided for by applicable law, which may include repair, replacement, a price reduction or a refund.

SECTION 12 – PRODUCT USE AND CARE

The customer is responsible for choosing the size and configuration best suited to their pet.

Breed and weight recommendations are a guide. If you are unsure, you can contact BerryPuff before purchasing.

The product must be used solely for its intended purpose and under the pet owner’s responsibility.

No textile product intended for animals can be considered completely indestructible. The customer is responsible for regularly checking the condition of the bed, stitching, hook-and-loop fasteners and individual components.

If any parts are damaged, detached or potentially dangerous, use must be stopped.

Covers and washable parts must be cared for in accordance with the instructions on the website, labels or documentation supplied with the product.

SECTION 13 – INTELLECTUAL PROPERTY

All content on the website, including text, photographs, videos, graphics, logos, names, visual elements, product structure and promotional materials, belongs to BerryPuff or is used with permission.

You may not copy, reproduce, distribute, modify, resell or use this content for commercial purposes without prior written permission.

Use of the website does not transfer any intellectual property rights to the user.

SECTION 14 – REVIEWS AND USER CONTENT

If you submit a review, photograph, video or other content relating to BerryPuff, you confirm:

  • that you have the right to share it;

  • that it does not infringe third-party rights;

  • that it contains no unlawful, offensive, misleading or defamatory material;

  • that it contains no viruses or malicious code.

BerryPuff may moderate, reject or remove content that breaches these Terms or applicable law.

Reviews must reflect authentic experiences and must not be used to spread information known to be false.

  • to infringe BerryPuff’s or third parties’ rights;

  • strikes;

  • transport disruptions;

  • widespread network issues;

  • unexpected unavailability of materials;

  • measures imposed by authorities;

  • events that temporarily prevent production or delivery.

In these circumstances, we will contact the customer and seek a reasonable solution, including a revised timeframe or, where necessary, cancellation of the order with a refund.

SECTION 20 – SEVERABILITY

If any provision of these Terms is considered invalid, unlawful or unenforceable, it will be applied to the extent permitted or severed from the rest of the document.

The remaining provisions will continue to be valid and effective.

SECTION 21 – NO WAIVER

Failure to exercise a right provided for in these Terms does not constitute a waiver of that right.

SECTION 22 – ENTIRE AGREEMENT

These Terms, together with the referenced policies and information displayed during purchase, constitute the agreement between BerryPuff and the customer concerning use of the website and purchase of products.

In the event of a conflict, mandatory provisions of applicable law prevail.

SECTION 23 – GOVERNING LAW AND JURISDICTION

These Terms and any separate agreements through which the Services are provided are governed by and interpreted in accordance with the laws of the Italian Republic.

Where the customer acts as a consumer, all mandatory rights and protections under consumer protection law remain applicable.

Any disputes will fall within the jurisdiction of the courts of the consumer’s place of residence or domicile, where provided for by law.

BerryPuff may update these Terms to reflect legal, technical or commercial changes, or changes to the services offered.

Changes do not affect orders already concluded, except where required by law or more favourable to the customer.
